Terms of Service

These Terms of Service ("Terms") govern access to and use of Gapwire at https://gapwire.probablysmart.com, operated by Probably Smart ("Gapwire," "we," "us"). By creating an account or using the service, you agree to these Terms.

The service

Gapwire provides brand coverage intelligence on X (topics, visibility sampling, weekly reports, and related workspace tools). Features depend on your plan and on proving ownership of the workspace's X handle where required.

Accounts

• You must provide accurate account information and keep credentials secure.
• You are responsible for activity under your account and workspaces.
• Agency claim links let a client prove X ownership without a Gapwire account; misuse of claim or disconnect links is your responsibility.

Acceptable use

• Do not attempt to bypass ownership gates, rate limits, or security controls.
• Do not use Gapwire to scrape X outside official API usage we provide.
• Do not upload unlawful content or infringe others' rights.
• Only Connect X or complete a claim for handles you are authorized to represent.

X platform

Gapwire uses the official X API and OAuth. Your use of X remains subject to X's terms and policies. X may change APIs, pricing, or availability; we are not liable for X platform outages or policy changes.

Plans and billing

Paid plans are billed through Stripe according to the prices shown at signup or in Billing. Trials, upgrades, and cancellations follow the product and Stripe customer portal flows. Fees are generally non-refundable except where required by law or expressly stated.

Intellectual property

Gapwire, its branding, and the product software are owned by Probably Smart or its licensors. You retain ownership of content you submit (brand signal, outcomes, etc.). You grant us a limited license to host and process that content to operate the service.

Disclaimers

The service is provided "as is." Intelligence outputs (Fit, visibility, Rooms, briefs) are directional decision support, not guarantees of reach, ranking, or business results. We disclaim warranties to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Probably Smart and Gapwire are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability for claims relating to the service is limited to the amounts you paid us for Gapwire in the three months before the claim.

Termination

You may stop using Gapwire and delete workspaces/account subject to product controls. We may suspend or terminate access for violations of these Terms, non-payment, or risk to the service or other users.

Changes

We may update these Terms by posting a revised version with a new "Last updated" date. Continued use after changes constitutes acceptance.
